1. Agreement to Terms
These Terms of Service govern your use of Nashir (nashir.ai), a social media scheduling and management platform operated by Nashir.
By accessing or using Nashir, you agree to be bound by these Terms of Service (“Terms”). If you are using Nashir on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
If you do not agree to these Terms, you may not use Nashir.
2. Description of Service
Nashir is a social media scheduling platform that allows teams to create, schedule, and automatically publish content to connected Facebook Pages, Instagram Business accounts, and YouTube channels via the Meta Graph API and YouTube Data API.
3. User Accounts
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorised use at legal@nashir.ai
You must provide accurate and complete information when creating your account. Nashir reserves the right to suspend or terminate accounts that contain false information.
4. Acceptable Use
You agree to use Nashir only for lawful purposes and in accordance with our Acceptable Use Policy. You must not use Nashir to publish content that:
- Violates any applicable law or regulation
- Infringes intellectual property rights of any third party
- Contains spam, misleading information, or unsolicited commercial messages
- Promotes violence, hate speech, or discrimination
- Harasses, intimidates, or threatens any person
- Contains malware, viruses, or other harmful code
5. User Responsibilities
You are solely responsible for:
- All content you schedule and publish through Nashir
- Ensuring you have the right to post content on the connected social accounts
- Compliance with Meta's Platform Terms and Community Standards, and the YouTube Terms of Service
- Reviewing how Google manages data in the Google Privacy Policy
- Compliance with the YouTube API Services Terms of Service when using YouTube features within Nashir. By connecting your YouTube account, you agree to be bound by the YouTube API Services Terms of Service.
- Compliance with all applicable laws regarding the content you publish
- Maintaining valid access to the social accounts you connect
Nashir acts as a scheduling tool only. We do not review, endorse, or take responsibility for content you publish.
TikTok Content Policy
By connecting your TikTok account and publishing content through Nashir, you agree that:
- You are the authorised owner of the TikTok account you connect
- All content you publish complies with TikTok's Terms of Service and Community Guidelines
- You agree to TikTok's Music Usage Confirmation for any content containing music
- Nashir is not responsible for content removed or accounts suspended by TikTok for policy violations
6. Service Limitations
Nashir is provided “as is” and “as available”. Nashir does not guarantee:
- That posts will be published at the exact scheduled time (delivery depends on third-party API availability)
- Uninterrupted, error-free operation
- That Nashir will be compatible with all future versions of third-party platforms
We reserve the right to modify, suspend, or discontinue any part of Nashir at any time with reasonable notice where practicable.
7. Payment Terms
Nashir offers paid subscription plans. By subscribing, you agree to the following:
- Billing: Subscriptions are billed monthly or annually in advance via Stripe.
- Free trial: Where offered, a 7-day free trial is available. No charge is applied until the trial ends.
- Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial periods.
- Price changes: We may change pricing with 30 days' notice. Continued use after the notice period constitutes acceptance.
- Taxes: Prices are exclusive of applicable taxes, which may be added at checkout.
8. Intellectual Property
Nashir, including its design, code, and brand, is owned by Nashir and protected by intellectual property laws. You retain ownership of all content you create and publish through Nashir.
By using Nashir, you grant Nashir a limited licence to store and process your content solely for the purpose of providing Nashir (i.e., scheduling and publishing your posts).
9. Termination
By you: You may stop using Nashir and delete your account at any time via Settings → Security → Delete Account.
By us: We may suspend or terminate your account immediately if you:
- Violate these Terms or our Acceptable Use Policy
- Fail to pay applicable fees
- Engage in activity that could harm Nashir, other users, or third parties
Upon termination, your right to use Nashir ceases immediately. We will delete your data in accordance with our Privacy Policy.
10. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NASHIR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT NASHIR WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NASHIR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE NASHIR, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
12. Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation, and if unresolved, through binding arbitration or the courts of the applicable jurisdiction.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in Nashir. Your continued use of Nashir after the effective date of revised Terms constitutes your acceptance.
